This is the page on our site where we get right to the point. Every mold is a potentially serious encounter. This must not be understated by anyone in the practice of its study. Understand its health and legal risks. 

      We see it very often after the fact (5 cases in 2003 and already 4 in 2004) where home inspectors are being sued for failing to note mold presence, identify mold, failing to sample mold correctly, failing to test it scientifically or failing to provide the correct analysis and coming to the wrong conclusions, with false positives and false negatives involving serious property damage with people and pets infected. If you suspect mold refer to a fungal mold mycologist.

       When this happens and property is transferred with a mold problem you will be sued. We may be able to help in your defense -  but better yet before you get there let our mold specialists do the analysis for you. If you see or suspect mold refer us - there is no reason for you to go out on the limb when it comes to doing a required full microbiological study that must only be performed by trained scientists.

        Insurance coverage for errors or omissions does not cover failure to use due diligence, not having competent training or expertise to conduct proper testing or misrepresentation of qualifications.  Insurance premiums go up and with possible cancellation.

Recent case (2004)in Sussex County: A couple purchases a "cute little retirement home"  2 months later, mold is found growing in the basement. Their 8 year old beagle gets a respiratory infection and is put on antifungals by their veterinarian and dies later from fungal infection of the heart. Couple gets very sick. Hires a "mold inspector" (really a repair contractor with a paper that says "I'm a mold inspector") that charged $15,000.00 to do mold related repairs. 6 months later mold comes back!

Who is their  attorney suing? :

1. Seller. Why? concealed mold with paint, siding and paneling.

2. Real estate broker. Why? They saw the mold before the cover up and failed to disclose it.

3. Home Inspector. Why? Did not note the mold in the report.

4. Mold Inspector. Why? Did not perform a competent inspection or remediation after charging a combined amount of over  $18,000.00 and the mold came back!

In closing we will say that you must understand that mold investigation is a highly technical study and scientific analysis. Its study and practice is not to be taken lightly nor added to a long list of other check-offs for a home inspector. Failing to use proper testing techniques and erroneous conclusions  may result in suit- ask your client to obtain a second opinion if in doubt. Refer to an experienced fungal mold mycologist.

If anyone is not adequately trained and makes a erroneous report  that results in a health injury a major liability will be placed upon that inspector. Mold is a disease a house gets and it can and will in time  pass to humans and animals. As a matter of law the courts have ruled disclaimers on any report will not release such inspectors no matter what the wording of the release if the inspection is flawed scientifically and worded broadly.

If you are not prepared to work with mold do not go near it. Your health is clearly at risk. If you smell mold put on a respirator with mask or get out quickly. IT DOES NOT MATTER IF THE CURRENT OCCUPANTS DO NOT CALIM A PROBLEM - THIS IS OFTEN THE CASE BECAUSE THEY HAVE BECOME RESISTANT OVER TIME TO THE SPIECE OF MOLD WITHIN THEIR HABITATION. You not having such resistance or tolerance may suffer toxic shock in as short as few minuets and at times a 4-6 hour delay resulting in "flu" like symptoms for weeks.
