We see it very
often after the fact (5 cases in 2003 and
already 4 in 2004) where home inspectors
are being sued for failing to note mold presence, identify mold,
failing to sample mold correctly, failing to test it scientifically or failing to
provide the correct analysis and coming
to the wrong conclusions, with false positives and false
negatives involving serious property damage with people and pets infected.
If you suspect mold refer to a fungal mold mycologist.
When this
happens and property is transferred with a mold problem you will
be sued. We may be able to help in your defense - but
better yet before you get there let our mold specialists do the
analysis for you. If you see or suspect mold refer us - there
is no reason for you to go out on the limb when it comes to doing
a required full microbiological study that must only be performed
by trained scientists.

Insurance
coverage for errors or omissions does not cover failure to use
due diligence, not having competent training or expertise to
conduct proper testing or misrepresentation of qualifications. Insurance

Recent
case (2004)in Sussex County:
A couple purchases a "cute little retirement home"
2 months later, mold is found growing in the basement. Their 8
year old beagle gets a respiratory infection and is put on antifungals
by their veterinarian and dies later from fungal infection
of the heart. Couple gets very sick. Hires a "mold inspector"
(really a repair contractor with a paper that says "I'm a mold
inspector") that charged $15,000.00 to do mold related repairs.
6 months later mold comes back!
Who is their attorney suing?
:
1. Seller. Why? concealed mold
with paint, siding and paneling.
2. Real estate broker. Why? They
saw the mold before the cover up and failed to disclose it.
3. Home Inspector. Why? Did not
note the mold in the report.
4. Mold Inspector. Why? Did not
perform a competent inspection or remediation after charging a
combined amount of over $18,000.00 and
the mold came back!
