BEFORE OCCUPANCY
Prevent tenant claims
for mold damage to property including clothing, furniture, books,
and other household items. Protect against
tenant mold health injury and disease claims by
inspecting immediately with full documentation. Obtain a
professional study, analysis, and recommendation for
repair, mold removal for full remediation and abatement
of any potentially toxic mold if so found.

Inspect
your rental before showing the property
Keep
unoccupied rental heated, ventilated and dry
Check
attic, basement, crawl space, closets, bathrooms,
and kitchen where mold is most often found.
Have all mold removed
or cleaned before showing the property to limit exposure to
persons entering property.
Do not cover-up mold
with paint, wallpaper or by other methods.
Concealed mold
may result in added punitive legal and other damage
awards along with full compensation for remediation and
repairs.
Obtain a
certification of a mold free habitation
File a property insurance
claim for water/mold damage.
Document the mold
damage.
A mold damaged home
is covered under most home owners insurance plans
Document the
remediation, abatement and associated repairs.
Obtain
a certified legal report from the mold inspector.
Do
not rent mold infested property to tenants -
considerable liability may result
Include in the rental
agreement that it is the duty of the renter to notify of any
water leaks or damage that may result in mold growth.
It
is a violation of health and building code to rent health
impairing property.
Note:
Nearly ALL rental property falls under the jurisdiction
of the Uniform Commercial Code.
Local municipal court has authority to address and remedy
complaints.

Before renting-look
for mold in all areas of the property
Spend a few
minuets in all areas of the house to detect mold
odor or
visual presence.
Leave any property
when mold is present either odor or visual.
Have the property
inspected for mold and fully document the findings.
Ask
the landlord to pay for a mold inspection
If mold is found and
removed have follow up certified mold inspection
Do
not rent mold infested property until remediation
(removing mold and eliminating source of
water) and cleaning
Once
rented it is the duty and
responsibility of tenant to notify and advise landlord
of any suspected mold growth
or water leaks immediately in WRITING

RENTAL AGENT
TIPS
Rental agent personnel are there first and are most likely to be
exposed to mold before their buyers. Be cautious- If
you see or smell mold:
Get
out immediately or wear mold gas/particle mask
Notify the landlord
and require a mold inspection and test.
People
living with mold often do not know it and may have
no or minimal allergic
response. Do not rely on their comments
Agents
can be just as liable for mold injury in their representation
of a property as being habitable.

WHAT
TO DO AFTER OCCUPANCY AND MOLD PROBLEMS ARE DISCOVERED
Estimates
are as high as 10% of all properties have a mold associated
problem. Most often mold is innocently overlooked, ignored
or just
not identified even during the course of a general home inspection.
A
Fungal Mold Mycologist must be consulted.
In
all cases if you find a mold shortly after you occupy
the property you must IMMEDIATELY have it
professionally inspected by a certified inspector and
mycologist. The inspector will document the damage and presence
of the mold infestation for you and your landlord. BUT this must be done immediately
- the longer you wait the more the liability transfers to you
- the new tenant.
IF
you have a health concern or newly acquired reaction that
you believe may be associated with a mold presence
see your physician immediately. Note in
most cases reactions will cease once away from the causative
factor.
