Florida House Bill 1629, “Relating to Affordable Healthcare”
was signed into law by Governor Jeb Bush on June 14, 2004. Among many
other provisions, this bill allows patients to obtain information
regarding hospital infection rates in an understandable format. [See
Section 11 of the bill, p.28; Florida Statutes, Section
408.05(3)(1)1.a.] The original sponsors of the hospital reporting
provisions were Senator JD Alexander and Representative Donna
Clarke.

Illinois was the first state to enact mandatory reporting
legislation.
In 2003, legislation requiring hospital infection rate data using the
definitions developed by the Centers for Disease Control and Prevention
(CDC) was introduced by state Senator Barack Obama (D-Chicago) and
Representative Mary Flowers (D-Chicago). The legislation also known as
the Hospital Report Card calls for disclosure of staffing levels by
clinical service areas such as critical care, pediatrics or the
medical/surgical departments. Reporting data will include surgical site
infections, ventilator-associated pneumonia and central-line bloodstream
infections which during the hospital visit. At present, the Illinois
Department of Health is developing rules pertaining to reporting.

Public Act 093-563 Creates the Hospital Report Card
Act. Provides requirements for staffing levels. Requires hospitals to
prepare a quarterly report detailing specified information as a
condition of licensure. Requires the Department of Public Health to
submit a report summarizing the quarterly reports by region to the
General Assembly and publish that report on its website. Provides
protection for whistleblowers.
Provides a private right of action to whistleblowers against their
employers. Provides penalties for violations of the Act. Amends the
Hospital Licensing Act. Provides that violations of the Hospital Report
Card Act are grounds for discipline under the Act.

Public Act 093-0144 Amends the Illinois Health
Finance Reform Act requiring all hospitals, ambulatory surgical centers,
and physicians licensed in the State to adopt a uniform electronic
system for submitting patient charges for payment from public and
private payors. Adds provisions concerning the collection and
compilation of patient charge and quality of care data. Requires the
Department of Public Health to inform the public regarding the
availability of comparison health care charge data and quality of care
information and to post certain information on its website by January 1,
2005. Requires the Department to study the most effective methods for
publicly disclosing patient charge data and quality of care information
and to report its findings to the Governor and to the General Assembly.
Requires the Department to protect patient confidentiality under State
and federal law.

Missouri was the
3rd state to enact mandatory reporting legislation. Senate Bill #1279, allows for an
advisory panel to dictate the rules for data collection, analysis, risk
adjustment, and types of infections. The advisory panel recently met and
approved the rules. They will begin by reporting central
line-associated bloodstream infections and six months following will
report risk-adjusted surgical wound infections for total hip
replacements, CABG, and abdominal hysterectomy. Recommendations
for reporting of ventilator-associated pneumonia continue to be
discussed.

Enacted Mandatory Reporting
Legislation
Missouri Senate Bill #1279, “The Missouri Nosocomial Infection
Control Act of 2004,” passed in May 2004 requiring public
reporting of risk-adjusted infection rates in hospitals and ambulatory
surgical centers. Senate Bill #1279, by Senator Sarah Steelman and
Representatives Rob Schaaf and Sue Schoemehl allows for an advisory
panel to dictate the rules for data collection, analysis, risk
adjustment, and types of infections. The advisory panel will consider
the standards established by the CDC for class I surgical site
infections, ventilator-associated pneumonia, central line bloodstream
infections and other categories. The first report has a deadline of
December 1, 2006.
